The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. In addition, BFSAT undertakes not to communicate, free of charge or with compensation, the contact details of its customers to a third party.

1. Acceptance of conditions

The customer acknowledges having read, at the time of ordering, the special conditions of sale stated on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between BFSAT and its customer, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior exemption, express and written.

2. Order

The automatic registration systems are considered proof of the nature, content and date of the order. BFSAT confirms the acceptance of his order to the customer at the email address that he will have communicated. The sale will only be concluded from the confirmation of the order. BFSAT reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information given by the buyer when ordering commits the latter: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

3. Delivery

After confirmation of the order and receipt of payment, BFSAT undertakes to send to the service provider selected when ordering (La Poste, GLS, DPD, etc.) all the references ordered by the buyer, within 48 working hours. The delivery service undertakes by contract with BFSAT to deliver the order to the buyer's address, which the latter will have provided to BFSAT.

In addition, for deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products: customs duty, value added tax, and all other taxes due under the laws of country of receipt of the order. Delivery will be made by post or GLS depending on the customer's choice of transport in Metropolitan France. Delivery is made to the customer by handing over the product to the announced recipient, either in the event of absence, to another person authorized by the customer, or deposited in Relay.

Deliveries in EU countries are made by Colissimo Post International or DPD following the choice of BFSAT. For addresses outside the EU, deliveries are made by international postal services. In the case of a technical product, the customer will take particular care to check the correct functioning of the device delivered and to read the instructions for use provided.

In the event of apparent defects, the buyer benefits from the right of return under the conditions provided for in these GTC. We advise you to always check your package on arrival and to refuse it if in doubt. We recommend that you contact us as soon as possible following receipt of your order to make any reservations with the delivery service, in the event of a missing product or damage, so that we are able to return against the carrier, and open a dispute on your behalf for the delivery problem. For reasons of availability and packaging, an order can be delivered in several separate parcels to the customer. The customer only pays for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the associated delivery costs. In case of unavailability of the goods ordered, BFSAT is required to inform the customer of the unavailability within 48 working hours, and to deliver the order in question within 30 days of the order being confirmed.

Free delivery: free delivery is only valid for individual accounts in mainland France.

Impossibility of delivery:

All errors on the part of the customer, that is to say: address error or parcel refusal, will result in the payment of the packaging and return service charges * upon reimbursement.

The prices of these costs are compared to the price of the order:

4. Withdrawal

You have 14 clear days (from receipt of the items) to form an opinion. In case of exercise of the right of withdrawal, BFSAT is required to reimburse the sums paid by the customer in full, the return costs remain the responsibility of the buyer; with the exception of prepaid cards of the Tntsat type: indeed, these (once unsealed and / or activated) are no longer salable, the sum relating to the card will therefore be deducted (for an amount of approximately € 25 depending on the current rates). The refund is due within a maximum period of 14 days, by the method of payment that the customer will have used when ordering.

According to article L. 121-21-3 of LAW n ° 2014-344 of March 17, 2014 relating to consumption, the customer undertakes to return the goods to BFSAT, without undue delay and, at the latest, within the fourteen days following the communication of its decision to withdraw in accordance with article L. 121-21-2, unless BFSAT offers to recover the property itself.

- How to return the items for refund or exchange?

When returning, attach a copy of the invoice, plus over-pack the original packaging of your products: BFSAT can only take back products returned in their entirety (packaging, cables, accessories, warranty coupons, drivers, manuals , covers, covers, protections, etc.), with their original packaging. For receivers, prepaid cards must not be unsealed. Moreover, if the activation of the parental code on a demodulator has been carried out by the customer, the code must be indicated to BFSAT on the copy of the invoice.

The refund or the exchange assumes that the product is not damaged: without traces, with its transparent films, without scratches or micro-scratches, or that it has not been returned incomplete.

Failing this, BFSAT will be entitled to apply a discount on the returned product, the amount of the damaged part, amount set by the supplier. In the event that the product has arrived unpacked or damaged at the after-sales service, BFSAT reserves the right to refuse the product as is.

We draw particular attention to the fact of over-packing the returned product, no self-adhesive adhesive, even transparent, must be affixed on the product or the original packaging.

5. Price

The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and EU countries. This price includes the price of the products, the costs of handling, packaging and conservation of the products, the costs of transport and commissioning.

 

6. Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by BFSAT. The price of the products is payable in cash on the day of the actual order. Payment is made by the following payment methods: check, paypal, transfer or bank card bearing the initials CB. Online, CYBERMUT allows you to pay via a CREDIT MUTUEL banking server in a secure environment. Your credit card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without going through the store's server, a guarantee which is all the more important as your bank details are only known. from our banking partner (CREDIT MUTUEL). The order validated by the customer will only be considered effective when the concerned bank payment centers have given their agreement. In case of refusal of the said centers, the order will be automatically canceled and the customer notified by email. In addition, BFSAT reserves the right to refuse any order from a customer with whom there is a previous dispute.

7. Disputes

This contract is subject to French law. BFSAT cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or the improper use of the products sold. The products offered by BFSAT are deemed to comply with the factory outlet of the manufacturer and are not in any way modified or sold with updates other than those installed by the manufacturer. If you choose to install other software in a device or to use a product other than for its main function for example, and your device breaks down, the manufacturer could refuse to take the product under warranty. In the event of a dispute, BFSAT is at your disposal to jointly find a solution to your problem. However, you have other remedies and are entitled to contact the following jurisdictions to represent your case: place of your domicile, place of actual delivery, place of performance of the service, place where you lived at the conclusion of the contract of sale.

 

8. Guarantee

The customer benefits from a guarantee of at least one year: if more, the duration will be indicated on the product. Products that are broken, damaged, have been in contact with any liquid, or have been misused are void their warranties. Flashing receivers also void warranties. The products not being concerned by these particular cases can be sent by the customer, accompanied by their accessories as well as their invoice.

It is recalled that within the framework of the legal guarantee of conformity, the consumer:

- has a period of two years from the delivery of the good to act vis-à-vis its seller;

- can choose between repair or replacement of the property, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;

- is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to 24 months from March 18, 2016, except for second-hand goods.

 

The legal guarantee of conformity applies independently of the commercial guarantee that may possibly cover your property. It is recalled that the consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

Product repair lasts a maximum of 30 working days, upon receipt of the package by us. In general, please contact us before returning any product. No cash on delivery will be accepted. In all cases, BFSAT cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country.
